WORK RULES
 

 

  1. Members may register for work by phone, fax, in person, or by mail.  In all cases, an out-of-work form must be properly completed by the member.  Therefore, on telephone calls to register for work the local office will not fill out the forms.  This is the members' responsibility.

  2. In order for members to register for work and to keep their name on the out-of-work list(s), members must: be in good standing at all times which means that all union dues and assessments are fully paid in accordance with the Constitution; keep the local office(s) informed as to their availability for work by checking in by phone, fax, in person or by mail at least once every thirty (30) days; and be available for work and notify the local office(s) when they become unavailable for work

  3. Members may put their name on more than one out-of-work list, however, the member must accept a call to go to work from any of those lists, whichever comes first.  A member called to work and refuses a job will be governed in accordance with Rule 6

  4. Applicable To All Members Except Those Members Reporting Back From Work in the Mainline Pipeline Sector
    Members reporting back on the out-of-work list with twenty (20) days or less of employment shall be displaced from their original listing(s) one (1) calendar day for each day worked up to twenty  (20) days or less.
    This does not apply where a member quits a job.  In this case the member is placed at the bottom of the out-of-work list(s)
    Members reporting in with twenty-one (21) or more days of employment must revert to the bottom of the out-of-work list(s) and re-register.


  5. Applicable Only To Members Reporting Back From Work In The Mainline Pipeline Sector
    Members reporting back on the mainline pipeline out-of-work list with ten (10) days or less of employment shall be displaced from their original listing(s) one (1) calendar day for each day worked up to ten (10) days or less.

    This does not apply where a member quits a job.  In this case the member is placed at the bottom of the out-of-work list(s).
    Members reporting in with eleven (11) or more days of employment in the mainline pipeline sector must revert to the bottom of the out-of-work list(s) and re-register

  6. If a member is called and refuses a job five (5) times on any out-of-work list(s), or there is no answer at the member's residence after five (5) calls for a job [or any combination of refusals and calls totalling five (5)], the member's name will be removed from all out-of-work lists, and the member will have to re-register
    Members living beyond toll free areas shall be called collect


  7. If a member takes a clearance card and cannot perform the required tasks of the job, the member shall be removed from the out-of-work list(s) until the member verifies to the satisfaction of the Union what jobs the member can perform in order that the member can be dispatched fairly.  At that time, the member's name will be placed at the bottom of the out-of-work list(s)
    A member who accepts a clearance card and fails to show up at a job site shall be placed at the bottom of the out-of-work list(s).


  8. Members working for or dispatched to a non-union contractor for the purposes of organizing are required to give their assistance to the Union as set out in the Constitution in order to remain on the out-of-work list(s).

  9. Members if eligible, may be recalled if there is a recall clause in the Collective Agreement embracing the particular Employer.  In all cases, members must notify the local office if they are recalled to work.

  10. Current out-of-work lists are available for inspection by the members.

  11. Any situation not specifically addressed by these work rules shall be prescribed by the Business Manager of the Union


CLARIFICATIONS

Guideline No. 01-01

 

In re-registration situations only, the dispatcher may use the member's last completed out-of-work form provided that:

 

a) the out-of-work form is accurate;

 

b) the out-of-work form does not require major changes for re-registration; and

 

c) the out-of-work form is less than one (1) year old

 

Where any uncertainty arises on the usability of a prior out-of-work form, a new form must be completed by the member

 

 

Guideline No. 01-02

 

In re-registration situations only, the dispatcher may use the member's last completed out-of-work form provided that:

 

a) the out-of-work form is accurate;

 

b) the out-of-work form does not require major changes for re-registration

(for clarity purposes, any change to the types of equipment a member is qualified and competent to operate is considered a major change)

; and

 

c) the out-of-work form is less than one (1) year old.

 

Where any uncertainty arises on the usability of a prior out-of-work form, a new form must be completed by the member.

 

 

 

Guideline No. 02-01

 

Subject to Work Rule #8, a member that is working may only remain on the out-of-work list(s) if he/she is not performing work that falls under the jurisdiction of Local 793.

 

 

Guideline No. 04-01

 

In calculating “days of employment” when a member reports back on the out-of-work list, the following definition is to be used:

 

  “Days of employment” means any day where earnings are paid, or will be paid, including monies paid in lieu of wages (i.e. show-up time allowance, room and board expense, inclement weather allowance, etc.), but does not include travel expense monies.

 

Guideline No. 06-01

 

In calculating the number of work refusals and calls to a member's residence, the general rule of using "separate calendar days" to determine each call and refusal shall apply.

 

Guideline No. 06-02

 

When a member is removed from the out-of-work list(s) due to unanswered calls at the place of residence, a letter explaining the removal shall be sent by the district office.
